Terms of Service

1. What the Service is

The Genesys is a “plug-and-print” platform for 3D printing: you can browse and obtain 3D model files (“Models”), have them prepared for your printer, and print them at home through the Genesys hub (“Hermes”) connected to a compatible 3D printer. Some features require the Hermes hub and a supported printer, a home Wi-Fi network and a compatible smartphone.

2. Account

You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for keeping your credentials confidential and for all activity under your account. You can delete your account at any time from the app (Profile → Settings → Delete account) or by writing to dev@thegenesys.tech; deletion removes your personal data as described in our Privacy Policy, subject to legal retention obligations.

3. G-coins

G-coins are a virtual credit used inside the Service to obtain Models and services. G-coins are purchased through the in-app purchase system of your app store (Google Play or Apple App Store), are personal, have no monetary value outside the Service, cannot be transferred to other users, exchanged for cash or withdrawn, and are non-refundable except where the law requires otherwise. Genesys may award bonus G-coins at its discretion. Prices and G-coin packages may change over time; the price shown at purchase applies.

4. Models and print rights

When you obtain a Model you receive a personal, non-exclusive, non-transferable licence to print it for your own private, non-commercial use, up to the number of copies indicated for that Model (“copies left”) or without limit where the Model is marked as unlimited. You may not resell, redistribute, publish, or share the Model file, nor remove any creator attribution. Free Models are subject to the same licence unless a different licence is stated by the creator. Digital content is made available immediately after purchase: by confirming the purchase you expressly consent to immediate delivery and acknowledge that you lose the right of withdrawal for digital content, as allowed by EU consumer law.

5. Certificates

The Service may issue a digital certificate that records your right to print a Model and, after printing, a record of the print. Certificates are records of use within the Service; they are not investments, securities or currency. Where blockchain-based features are available, they are optional; network fees charged by third-party networks or wallets are not charged by Genesys and are not refundable by Genesys.

6. Printing — your responsibility and safety

3D printing involves heated components and moving parts. You are responsible for operating your printer and the Hermes hub safely, following the manufacturer’s instructions, supervising prints, and keeping children and pets away. Genesys prepares files and sends print commands as a service but does not control your printer’s hardware, firmware or environment. Print results depend on your printer, material and settings; we do not guarantee that every Model prints successfully on every printer. Where a printer model is marked “untested” or “community”, it means we have not verified it ourselves.

7. Hardware (Hermes hub and kits)

Physical products sold through the Service (such as the Hermes hub or printer kits) are subject to the sales conditions shown at checkout, the legal warranty of conformity (2 years for consumers in the EU) and the 14-day right of withdrawal for consumers, as provided by law. Printers included in kits are manufactured by third parties and carry their manufacturer’s warranty.

8. Creators and user content

Creators may publish Models through the Service. By publishing, a creator warrants that they own or are licensed to use all rights in the Model and its images, and grants Genesys a licence to host, display, prepare and deliver the Model to users. Genesys may remove content that infringes rights or these Terms. To report a Model you believe infringes your rights or is inappropriate, write to dev@thegenesys.tech with the Model name and the reason; we review reports and act promptly.

9. Acceptable use

You agree not to: misuse or reverse-engineer the Service, the hub or its software; use the Service to print objects that are illegal, dangerous (including weapons or their parts) or that infringe third-party rights; interfere with other users; or circumvent copy limits, licences or payment systems.

10. Payments

Purchases of G-coins are processed by your app store under its terms. Other payments (for example physical products or saved payment cards) are processed by Stripe; Genesys does not store full card numbers. Prices are shown in euro (or in G-coins) and include applicable taxes unless stated otherwise.

11. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted operation. We may update the app, the hub software and these Terms; material changes will be announced in the app or by e-mail, and continued use after the effective date constitutes acceptance. If you do not accept a change, stop using the Service and delete your account.

12. Liability

To the extent permitted by law, Genesys is not liable for indirect or consequential damages, loss of data, or damage to printers, materials or property caused by misuse, unsupported hardware, third-party products or failure to follow safety instructions. Nothing in these Terms limits liability that cannot be limited by law, including consumer rights under Italian and EU law.

13. Termination

We may suspend or terminate accounts that breach these Terms. You may stop using the Service at any time. Sections that by their nature survive termination (licences already granted, liability, disputes) remain in force.

14. Law and disputes

These Terms are governed by Italian law. For consumers, mandatory protections of the country of residence apply and disputes may be brought before the competent court of the consumer’s residence; EU consumers may also use the European ODR platform. For all other cases the courts of Milano have jurisdiction.
